What is it?
LDA vs. a Paralegal
Paralegal
A paralegal, by law, cannot do work for the general public on their own. Paralegals cannot accept fees for services or independently prepare documents for consumers/the general public. A paralegal works under the direct supervision of an attorney and cannot provide any services directly to the public, or to an attorney’s client unless the attorney has specifically instructed the paralegal to do so. In terms of an education difference between the paralegal and a legal document assistant, there may not be a difference depending on the paralegal or legal document assistant you are working with. They both require a certain amount of legal education and most individuals have degrees backing them. Individuals whom draft legal documents and represent themselves to the public as a paralegal without working under the direct supervision of an attorney are breaking the law. This is called the unlawful practice of law and is punishable by a misdemeanor.
Legal Document Assistant
California Business and Professional Code §6400(c)(1) states a Legal Document Assistant (LDA) is any person who provides, or assists in providing, or offers to provide, or offers to assist in providing, for compensation, any self-help service to a member of the public who is representing himself or herself in a legal matter, or who holds himself or herself out as someone who offers that service or has that authority. SB1418 authorizes an LDA to provide clients with help in the preparation of court papers and legal forms for filing with the California courts. This law authorizes non-lawyers to prepare and file legal documents for people doing their own legal functions. LDA’s are required by law to be registered and bonded in the county in which they provide services. An LDA is not an Attorney and cannot provide legal advice. LDA’s, as we do, work with attorneys to help their clients get the necessary legal questions answered. We can then provide document services for the client. When you hire a LDA you are representing yourself and the LDA is working under your direction.
